How do you read sections 477 and 478 of the Biosecurity Act 2015? What obligations are in the legislation that requires the government to do B?
You say “The current federal government appears to be fully in support of option A”. What proportion of their support comes from financial incentives rather than reducing risk?
Then you say “Which option do you support?” If we as a nation supported B the concern for the IHR amendments would be less. There would also be more responsibility placed on Australia’s sovereign decision making.
Would you walk me through “If legislation is not passed in Australia mandating compliance with the WHO recommendations, they would be binding under international law, but not enforceable (and therefore not really binding in a practical sense) in Australia.” My concern is that a “Cab(inet)al meeting would be called if there is a next pandemic and the states would all fall into click step as occurred in 2020 pursuant to the Biosecurity Act 2015 and Acts since then REGARDLESS OF WHETHER THE IHR amendments are passed or not.
Also for a more detailed discussion of “If legislation is not passed in Australia mandating compliance with the WHO recommendations, they would be binding under international law, but not enforceable (and therefore not really binding in a practical sense) in Australia.”…see the legal opinion downloadable from this article
Hi Carol, sadly I agree with you re “if there is a next pandemic and the states would all fall into click step as occurred in 2020 pursuant to the Biosecurity Act 2015 and Acts since then REGARDLESS OF WHETHER THE IHR amendments are passed or not.”
Wonderful explanation Libby, thank-you. The simplest & most cost effective way out of this globalist horror show is still to exit the WHO.

When our governments want to willingly submit to the WHO it doesn’t really matter whether it’s a legal obligation to do so, so we could all save ourselves a lot of bother arguing about whether the recommendations will be binding or not. It’s a tedious topic! See my latest post on it here https://open.substack.com/pub/libbyklein/p/update-on-binding-recommendations?r=1cmbrn&utm_campaign=post&utm_medium=web
Very valuable summation which I have used (slightly amended) to my local Labor MHR - thank you Libby.
